By entering the Hoy website you agree to abide by the Terms and Conditions of use. we assume you accept these terms and conditions in full. Do not continue to use Hoy’s website if you do not accept all of the terms and conditions stated on this page. A placement of an order online indicates your acceptance of these Terms & Conditions.
Orders shall be accepted at our sole discretion but will normally be accepted if the goods that you order are in stock and your payment method is authorised for the transaction. You will be charged automatically when you place your order. If for any reason we are unable to fulfil your order, we will notify you at the earliest opportunity where a replacement or a full refund will be offered.
Ownership of the goods that you (the customer) purchase will be retained by us (Hoy) until they have been delivered to the address specified at the time of purchasing. We will endeavour to contact you by any means if any issues arise.
We (Hoy) will do our best to ensure pricing and promotions are displayed correctly on our website, however, if for any reason there are discrepancies, we reserve the right to amend/cancel your order. We will contact you by email/telephone prior to completing any order with price or promotional changes.
While all reasonable attempts are made to ensure the images of our goods/services are shown accurately on our website, there may be slight variations in colour and/or texture between some images and the goods themselves. Computer monitors may display colours differently to individuals, we cannot accept responsibility for any discrepancies in colour variation.
Right of Withdrawal (EU Customers) If you are located in the European Economic Area (EEA), you have the right to withdraw from your purchase within 14 days of receiving your goods, without giving any reason. To exercise this right, please contact us at james@hoysurf.com or use our withdrawal form available on our website. Return shipping costs are at your expense. We will process your refund within 14 days of receiving the returned goods. This right does not apply to custom or personalised items, perishable goods, or sealed goods unsealed after delivery for hygiene reasons.
Conformity of Goods All goods sold by Hoy must conform to the contract of sale. This means goods must be as described, fit for purpose, and of satisfactory quality. If goods do not conform, you may be entitled to a repair, replacement, or refund under applicable consumer protection law, including EU Directive 2019/771/EU on the sale of goods.
Governing Law & Consumer Rights These Terms and Conditions are governed by the laws of England and Wales. However, if you are a consumer resident in the EEA, you will always retain the protection of the mandatory consumer protection laws of your country of residence, regardless of the governing law stated here.
Dispute Resolution We always aim to resolve any disputes directly with our customers. If we are unable to resolve a dispute, EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.
